1. New changes on Employment Act 1955 – postponed to 1 January 2023
 
Datuk Seri M Saravanan, Minister of Human Resources has announced on 26 Aug 2023 during a press conference, that the execution of Employment Act 1955 amendments will be postponed to 1 January 2023.

The amendments initially were scheduled to take effect from 1 September 2022. For your reference, below are some important suggested amendments: 
 
  1. Female employees will be entitled to 98 days of maternity leave, increased from the previous 60 days maternity leave
  2. Married male employees will now be entitled to 7 consecutive days of paternity leave, restricted up to 5 confinements irrespective of the number of spouses. He also needs to be employed by the same employer at least 12 months immediately before commencement of such paternity leave
  3. Hospitalisation leave will no longer be deducted after sick leave has been applied as it has been separated out. 
  4. Weekly working hours to be reduced from 48 hours to 45 hours

The system will be amended accordingly for the new accounts by then. While for the existing accounts, you may need to make the changes. We will publish a step-by-step guide for you in the system by December 2022. 
 
These changes should be applied at the latest by 1 Jan 2023 to stay compliant. Small note that because customers have respective customized settings, it may not be appropriate for us to make the changes.
2. PERKESO has increased the maximum wages ceiling from RM4,000 to RM5,000 
 
Under AKTA 4 of Social Security Act, the wages ceiling was at RM4,000 (this means any wages above RM4,000 are contributing RM19.75 – employee & RM69.05 – employers respectively), prior to 1 September 2022.
 
From 1 September 2022 onwards, the wages ceiling now is capped at RM5,000. This will change the maximum contribution amount to RM24.75 – employee & RM86.65 – employer respectively. 
AKTA 800 (EIS) would also be affected, and the new maximum contribution amount will be RM9.90 (increased from RM7.90) for both employee & employer respectively. 
 
Our system will be updated sometime mid-September to reflect the new requirements. As always, any changes on statutory requirements will be updated in the system, so you can have peace of mind all the time 😊
