3. PDPA (Amendment) Act 2024 - Your Organization Must Now Appoint a Data Protection Officer (DPO) Effective October 17, 2024, your organization is required to appoint a Data Protection Officer (DPO) under the new Personal Data Protection (Amendment) Act 2024. What Is the PDPA? The Personal Data Protection Act 2010 (PDPA) is Malaysia’s law that regulates how personal data is used in business. Its goals are to: a) Protect personal data during commercial activities, b) Ensure organizations handle personal data responsibly, and c) Prevent misuse of personal information. Why Were the Laws Updated? With the rise of digital technology, the Government has updated the PDPA to reflect current realities and align Malaysia with global standards. These amendments, now in effect, aim to strengthen personal data protection while keeping pace with technological advancements. |
We understand that for smaller organizations, hiring a full-time DPO might be a financial challenge. But there’s good news—appointing an external DPO is an option worth considering. The Personal Data Protection Commissioner’s Office has confirmed in its public consultation papers that organizations can appoint an external DPO, which is particularly helpful for smaller businesses or those without in-house expertise. An external DPO allows you to comply with the law without the added expense of hiring a full-time employee, offering a practical and cost-effective solution to meet your obligations. To support you, Kakitangan.com is in the midst of organizing a PDPA insights event in January 2025, where our legal sifu, Mr. Suren Rajah will be sharing practical steps to help your business stay compliant with the amended law. If you’re unsure how these changes impact your business or would like to discuss the role of an external DPO further, feel free to reach out to our Legal Sifu, Suren Rajah. You can get access of appointment booking via HR Sifu Platform here. Please let us know if you do not have access to HR Sifu Platform and wish to subscribe to Kakitangan.com. |
